(2) The flag of the Republic of Austria consists of three horizontal stripes of equal width, of which the middle one is white and the upper and the lower ones are red.
The flag of the Republic of Austria serves as the general mark of belonging to the Republic of Austria.
The colours of the Austrian flag are derived from the last Babenbergs.
In any case, the legend of the choice of the red-white-red coat of arms by Duke Leopold V ("the Virtuous") cannot be historically substantiated; after the battle at Acre his white tunic is said to have been soaked red with blood except for a stripe covered by the sword belt.
On 31 October 1918, even before the proclamation of the First Republic, the State Council, which was provisionally conducting the business of government, on the proposal of the later Federal President Wilhelm Miklas, established the colours red-white-red as the "German-Austrian state colours".
The legal establishment took place in the Act on the Form of State of 21 October 1919 (StGBl. No. 484/1919), Article 6 of which read: "The flag of the Republic consists of three horizontal stripes of equal width, of which the middle one is white and the upper and the lower ones are red". With this, the national flag of the new Austria is described for the first time.
the red-white-red flag was prohibited; after the liberation of Austria it was reintroduced.
With the 1981 amendment to the B-VG, BGBl No. 350/1981, Article 8a was inserted into the Federal Constitutional Law, paragraph 1 of which reads: "The colours of the Republic of Austria are red-white-red. The flag consists of three horizontal stripes of equal width, of which the middle one is white and the upper and the lower ones are red."
